The seller announce a new price and a change in the purchase procedures which on force as of today December 15th. 2007. The new procedures are as follow: 1) Buyer will send the LOI on his letterhead (LOI wordings will be furnished from the seller). 2) Along with the LOI a bank capability letter on buyers bank formal letterhead signed by two bank officers and sealed confirming the funds availability for the first month delivery. (The original BCL to be sent by courier to the seller) 3) Seller will send signed FCO along with the supply contract for buyer's revision and executions. 4) Buyer will open two letters of credits: The first Letter of Credit equal of one month supply which will be use as a deposit to ensure the continues of the contract. This letter of credit is applied against the sale price per MT over the term of the Contract resulting in a reduced billing per MT against the Letter of Credit, Which means ( for example ) : 30,000 MT. HMS 1 & 2 X $220.00= $6,600,000 The Security L/C Value $6,600,000 on 12 months = $550,000 monthly $550,000 on 30,000 = a deduction of $18.34 a Metric Ton which means the Metric Ton after deducting the security portion will be: 30,000 X ( $220.00 - $18.34 = $201.66 ) = $6,049,800 monthly delivery The second Letter of Credit will be documentary, confirmed, revolving 100% payable at sight against documents which will be listed in the contract for the following amount. 30,000 MT x ( $220.00 - $18.34 = $201.66 ) = $6,049,800.
